Terms of Use
1. INTRODUCTION
1.1 Thank you for your interest in Swedavia APIs. Swedavia APIs are a collection of APIs collected and compiled by Swedavia and its partners, provided to you by Swedavia for the purpose of encouraging the development of applications, web services and similar developments.
1.2 Provided that you:
(a) register an account with Swedavia at api.swedavia.se,
(b) choose the type of API which best fits the purposes of your intended development (for detailed information about the technical requirements and limitations of each API type, see the technical documentation provided with each type of API) and
(c) click to accept these Terms and Conditions
Swedavia grants you a license to the API of your choice in accordance with the following.
2. DEFINITIONS
2.1 "Swedavia" means Swedavia AB (publ), (corporate ID no. 556797-0818).
2.2 The "User" means Swedavia’s counterparty in the Agreement.
2.3 The "General Terms and Conditions" means these Terms and Conditions.
2.4 The ”Technical documentation” means technical requirements and limitations provided in the technical documentation of each type of API.
2.5 The ”APIs” means a collection of Application Programming Interfaces collected and compiled by Swedavia AB and its partners.
2.6 The “Provided Data” means the data provided from the APIs.
3. LICENSE GRANT
3.1 The Terms and Conditions and the Technical Documentation constitute the entire agreement between the User and Swedavia and govern the use of the API and the Provided Data, superseding any prior agreements between the User and Swedavia.
3.2 When accepting the Terms and Conditions the User agrees to observe the limitations set forth in the Technical Documentation.
3.3 Swedavia grants you a worldwide, non-exclusive, non-transferable, non-assignable license to the API, for the purpose of accessing, using and publicly displaying the Provided Data in your application, web server or similar development.
3.4 Clearly stating that the Provided Data originates from Swedavia is mandatory.
3.5 The license shall in no way be construed as a limitation of Swedavia’s and its original sources’ right to freely utilize, develop or delete the API, the Provided Data or products and services based thereon. Swedavia intends to inform about such changes in the API in advance. 3.6 Combining information from the Swedavia API with other information is allowed.
3.7 Sharing unchanged information from the Swedavia API in your own applications, web services and similar is allowed. Sharing unchanged information from the Swedavia API to other systems is not allowed. Selling unchanged information from the Swedavia API to third party is not allowed. However, once the information from the Swedavia API is enriched or refined, selling to third party is allowed with a written permit from Swedavia.
3.8 Sharing or selling changed and modified information from the Swedavia API, together with other information, in the Users applications, web services and similar is allowed.
4. TECHNICAL REQUIREMENTS
4.1 In order to secure the availability and performance of the API and the Provided Data, developments based on the API shall be constructed in a way that minimizes the capacity burden of the API. For this purpose, certain technical requirements and limitations are provided in the technical documentation for each type of API.
4.2 Certain technical limitations, such as the number of requests per minute or month, may be improved by subscribing to a premium account. The terms and conditions for a premium account are stated in the Technical Documentation. Changes to other technical limitations, such as technical support etc., may be arranged through at specific agreement with Swedavia. If you are interested in such individual agreement please contact Swedavia at api@swedavia.se.
4.3 Data requests in excess of or otherwise in breach of the technical limitations provided in the Technical Documentation may be blocked by Swedavia. Swedavia also reserves the right to terminate such license to the API in accordance with section 11 below.
5. REQUIREMENTS ON USE
5.1 Applications, web services and similar developments which contain information retrieved via the API shall expressly state that the product or service is based on information retrieved from Swedavia and, when practicable, a hyperlink to Swedavia (www.swedavia.se) shall be provided.
5.2 When using and embedding the API into an application, web service or similar development the User may not:
(a) assign, transfer or disclose the API key to any third party,
(b) transmit any viruses, worms, defects, Trojan horses or any such items of a destructive nature,
(c) infringe any third party intellectual property rights,
(d) access or use the API or any Provided Data through any technology or means other than those provided through api.swedavia.se,
(e) use the API or the Provided Data in a manner which directly or indirectly opposes or obstructs the purpose of Swedavia,
(f) use the API or the Provided Data in a manner which disparages, infringes or dilutes the name, trademarks, logos, domain names and other distinctive brand features of Swedavia or its partners,
(g) otherwise use the API or the Provided Data in any illegal manner.
6. PROVISION OF THE API
6.1 The API and the Provided Data are provided on an “as is” and “as available” basis, with no warranties whatsoever regarding its security, reliability, timeliness, availability or performance. Our intention is to have an uptime of at least 99%. Thus, the Technical Documentation does not contain, and shall not be construed as, any binding commitment that the API will at all times meet the service levels set out therein, the API will be uninterrupted, timely, secure or error-free or that any errors in the Provided Data will be corrected, and Swedavia makes no such warranty or undertaking.
6.2 Swedavia may, at its sole discretion, change or release subsequent versions of the APIs or the Provided Data. The User will use and comply with the most current version. Swedavia’s intention is to inform about such API-changes in advance.
6.3 If the User finds a subsequent version of the API or the Provided data unacceptable, the User may cancel the API at any time by deleting the API from the application, web service or similar development. A continued use of the API or the Provided data constitutes an acceptance of the modified/updated API.
7. INTELLECTUAL PROPERTY
7.1 The User acknowledges that Swedavia and its partners own all legal right, title and interest, including without limitation all intellectual property rights, to the API and the Provided Data. The User shall not acquire any right, title or interest in the API or the Provided data except as set forth in the Terms and Conditions.
7.2 For purposes of these Terms and Conditions, Swedavia hereby grants the User a worldwide, non-exclusive, non-transferable, non-assignable license to display Swedavias trademarks, logotypes and domain names, in order to advertise the use of Swedavia APIs. The User grants Swedavia a worldwide, non-exclusive, non-transferable, non-assignable license to use trademarks, logotypes and domain names to advertise that The User are using the Swedavia APIs.
8. LIMITATION OF LIABILITY
8.1 The User uses the API at own discretion and risk, and agree that Swedavia and its partners shall not be liable to you for any direct, indirect or other damages - including but not limited to damages for loss of data, loss of profits, loss of use or loss of goodwill - resulting from the use or the inability to use the API.
9. INDEMNIFICATION
9.1 The User agrees to indemnify and hold harmless Swedavia and its agents, employees and partners against any third party claim or any other actions connected with or arising from the Users use of the API or Provided Data, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs or attorney’ s fees of every nature.
10. PROCESSING OF PERSONAL DATA
10.1 The User understand that and agree that any personal data provided by you to Swedavia may be processed by Swedavia for the purpose of administrating, supervising and rendering your use of the API more effective. In such processing, Swedavia is the controller of the personal data in accordance with Personuppgiftslag (1998:204).
10.2 You are entitled to information about Swedavias processing of your personal data, and to require that any erroneously processed personal data is corrected, blocked or deleted, by contacting Swedavia at api@swedavia.se.
11. TERM AND TERMINATION
11.1 The Terms and Conditions are valid from the date the User accepted them until terminated by either one of the parties. Either party may terminate the Terms and Conditions at any time with immediate effect.
11.2 When the Terms and Conditions is terminated all license rights granted herein is terminated. Swedavia will terminate the provision of the API to the User who you must immediately cease to use the API, the Provided Data and trademarks of Swedavia.
12. MODIFICATIONS
12.1 Swedavia may modify the Terms and Conditions and the Technical Documentation. A prior notice of the modifications will be sent to the e-mail address the User registered when signing up for the API. Changes will become effective by the date specified in the notice. 12.2 If the User does not agree to the modified Terms and Conditions or the modified Technical Documentation for an API, the User should stop using the API. If the User continue to use the API it constitutes an acceptance of the modified Terms and Conditions or the modified Technical Documentation for that API. 12.3 The current version of the Terms and Conditions and the Technical Documentation can always be reviewed at api.swedavia.se, or any successor URL that Swedavia may designate.
13. MISCELLANEOUS
13.1 The Terms and Conditions may be assigned by Swedavia and will inure to the benefit of Swedavia, its assignees and successors.
13.2 The failure of any party to enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of the Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms and Conditions remain in full force and effect.
14. GOVERNING LAW
14.1 The Terms and Conditions are construed in accordance with and shall be governed by the laws of Sweden, without regard to its conflict of law provisions.
15. DISPUTES
15.1 Any dispute arising from the Terms and Conditions or the APIs shall be settled by Swedish court, with Stockholm district court as first instance.
